(D) would indicate a vessel that was choosing to not make way. The described vessel has lost it's ability to make way. |

You have went from a Power Driven Vessel Underway Making Way to a vessel Not Under Command due to an exceptional circumstance i.e. losing propulsion. Therefore, you would then change your signal to that of N.U.C. Rule 3 General Definitions paragraph (f): The term "vessel not under command" means a vessel which through some exceptional circumstance is unable to maneuver as required by these Rules... Rule 35 Sound Signals in Restricted Visibility paragraph (c) BOTH International and Inland: A vessel not under command, a vessel restricted in her ability to maneuver whether underway or at anchor, a sailing vessel, a vessel engaged in fishing whether underway or at anchor and a vessel engaged in towing or pushing another vessel shall, instead of the signals prescribed in Rule 35(a) or (b), sound at intervals of not more than 2 minutes three blasts in succession, namely one prolonged followed by two short blasts. |
