Agreed, Rule 17 (a)(ii) says the SOV “may” take action to avoid collision by her maneuver alone when it becomes apparent that the GWV is not taking appropriate action. However, Rule 17 (b) says when the SOV finds herself so close to a collision that action by GWV alone won’t prevent collision, “she SHALL” take such action that will best aid to avoid collision”. So, the SOV “may” maneuver, but she “must” take action. Maybe she should slow? Now look at Rule 34 (d) which says when vessels are in sight and approaching one another, and one vessel “is in doubt whether sufficient action is being taken by the the other to avoid collision, the vessel in doubt SHALL immediately indicate that doubt by giving at least 5 short and rapid blast of the whistle. The “shalls” outrule the “mays”. |

no where in rule 17 does it say you are required to sound the danger signal. If the give way is not taking appropriate action, you are to maneuver |
